Now the DLD has made a new move to minimize the legal issues and to safeguard investors’ rights. The initiative named Tanweer is expected to boost the real estate market of the country by further assuring the investors of their rights.</p>
<p style="text-align: justify;">Chairperson of the Center for Promotion and Management of Real Estate Investment, Majida Ali Rashid was reported as saying that Tanweer is aimed at boosting investors’ faith in the country’s real estate market. She says it is aimed at acting as a standard-setter about the privileges and obligations of real estate investors. It will help in ensuring transparency in the nation’s real estate market.</p>

<p style="text-align: justify;">Tanweer will contribute in organizing the real estate market better. It will make the sale and purchase of real estate transparent; and the foreign investors will feel safer investing here. As it would start working as a reference guide, the legal disputes will come down. However, no details on the exact time the initiative will come into effect or how exactly the investors will be benefited through it has been made clear.</p>
<p style="text-align: justify;">Tanweer has come in the backdrop of DLD’s announcement in October 2011 that it employed competent experts to examine and improve the real estate investor protection law by the end of 2011. It is expected now that Tanweer will bring in precision on various concerns like the steps to be taken by an investor in case of any delays in the projects.</p>
<p style="text-align: justify;">It should also deal in cancellation of a contract by an investor, if the contractors are unable to honor the stated obligations. Though there is already a body to look into resolving any such issues on behalf of the DLD, either party may now move to the court as well.</p>
<p style="text-align: justify;">Tayseer and Tania have been the earlier initiatives launched respectively in July 2010 and September 2011. These deal in financing for purchases and completion of projects.</p>
<p style="text-align: justify;">As a part of long term planning for boosting the real estate market in Emirates, the code of conduct for corporate field is to be implemented from the next year. It will make it obligatory for every developer to disclose alternatives with recourse in case they fail to honor the time given to the investors for transferring the property. The investors will also be benefited by getting other swaps and refunds options from the companies.</p>

			<content:encoded><![CDATA[<p>The developer of the Palm and World Islands, Nakheel lost in two cases this week. This lost will cost the company a $23m. The former CEO of this building company, Chris O’ Donnell was awarded $3m for his damage for breaching a contract between him and the company. After working with the company for 5 years, he left it last summer and sued a case of $3.7m for his loss in incentives, entitlement loss, and salary and exchange rates losses.</p>
<p>He also sought a payment for a business class airline ticket form Dubai to Australia. The World Island Tribunal has paid him $3m for long-term payment. But, it has rejected him to pay the flight fare.</p>

In a statement after the verdict he “Whilst I have been entirely vindicated by the Dubai World Tribunal, I am naturally disappointed that &#8230; the matter was not able to be resolved amicably without the need to take costly legal proceedings that vented Nakheel&#8217;s internal business in a public forum”.</p>
<p>The company’s legal adviser said that the cases must be taken further by the Federal Court and not by the tribunal. This is the tribunal which order Nakheel to pay only $20m to an Abu Dhabi Contractor for completing its work on a residential apartment.</p>
<p>Nakheel has only 14 days time to pay off this amount of the Technical Architect for failure in payment. This is really a blemish in the white collar image of the company and the World Famous Developer, Nakheel. It’s now time for others to sit and see how Nakheel receives back its du amount of respect and credibility among the others in real estate sector of Dubai.</p>
<p>On this connection, it’s better to remember that TAGC was awarded to DHs950m for building 31 apartments but, it was ultimately forced to leave the work. Will Nakheel face the same challenge? Questions are arousing higher in the mind of the writers. What to do now is that just wait and watch what happens in the fate of giant builder.</p>

<p style="text-align: justify;">These steps taken by the government have borne fruits ion the form of market gaining back trust and as a result investors are waiting to jump in the investment market.</p>
<p style="text-align: justify;">To see complete recuperation in real estate of Dubai, people might have to wait for quite some time. As the government has also taken its stand, this state of complete recuperation is not a questionable act but also when it happen is not decided. </p>

The Land Department of the Gulf along with Real Estate Regulatory Authority( Rera) is Conducting is his training programme to attain more transparency in work and enhanced scope for investment from Abroad. The training for the brokers will begin from later this month a report says.</p>
<p style="text-align: justify;">RERA is a regularity body of the Land Department of the Government to keep record, assuring the rights related to sale and purchase of land. The entire training will be divided into three stages. First one is “experimental, educational and optional.” Second comes with training and co-ordination and the third involves the right the Charter and is very much compulsory.</p>

<p style="text-align: justify;">This training is aiming at the very target of educating the 2.084 real estate brokers working in 840 real estate offices in Dubai. The authority is confirming that it will enhance the quality, skill, expertise of these vast numbers of brokers working in the real estate industry. The CEO of RERA has shed some light on their planning for these three staged programme.</p>
<p style="text-align: justify;">He added that work culture is lacking mostly in the labor market of Dubai. Especially, the real estate industry is suffering from these problems the most. Another is reason behind training these people are really evident that the Government body wants to train everybody to make the Charter a reality of most unorganized but highest revenue generating industry of the country.</p>
<p style="text-align: justify;">The government wants to make the brokers knowledgeable and well aware to make sure that real estate industry is working in a better, ethical and proficient way. They are reportedly trying hard to bring the country up to International level.</p>
<p style="text-align: justify;">Experts say that this training decision was taken from the inception of the RERA. Now, it’s really a burning question to update real estate professional to a higher level.</p>

			<content:encoded><![CDATA[<p style="text-align: justify;">These are the names of the initiatives taken by the Dubai Land Department: Tayseer and Tanmia. These will help in reviving the real estate market in Dubai.</p>
<p>Tayseer will help financing through local banks while Tanmia will target getting more investments through rejuvenating the stalled projects. The latter is an initiative by Real Estate Investment, Promotion and Management Center—REIPMC.</p>

<p>Tayseer will help the buyers of many unqualified projects with financing. The qualification process is a long process that involves identification of a project by the DLD.</p>
<p style="text-align: justify;">The projects are then subject to be qualified by the government. Government has its own criterion for qualification like it considers only those projects, 60 percent of which is already sold at the time of identification.</p>
<p style="text-align: justify;">It should further be 60 percent complete in its construction process; rest construction be going on at the scheduled pace in conformity with the Real Estate Regulatory Agency approvals. There are also other factors like a reliable contractor who could guarantee a timely completion of the project.</p>
<p>The government backs local banks in financing the purchasers of the property. The Dubai Land Department (DLD) signs deal with the local banks to this effect. The purpose of this financial backing is to ultimately get the projects accomplished timely.</p>
<p style="text-align: justify;">Seven local banks have signed agreements in this context so far. As many as 40 projects have been qualified under the initiative and have been registered as phase-one initiative. Some 215 investors have taken benefit from this scheme so far.</p>
<p>There are some 26 projects that are being considered for approval. The projects are illustrative of what thrust the government has been giving to the repairing of the losses, the Dubai real estate has suffered since the global financial crisis struckDubai adversely.</p>
<p style="text-align: justify;">Though the procedures involved in the Tayseer and Tamnia initiatives are long, the long term effect of these well-stressed schemes is expected to boost the market soon.</p>
<p style="text-align: justify;">It is also expected to help the market fight the challenges brought about by depreciation of rupee against dollar. The latest developments in this regard indicate NRIs (Non Resident Indians) may seek investment in their homeland as the properties there will cost less to them.</p>
